What Is a Trademark?

A trademark is a type of intellectual property that can be a word, phrase, symbol, design, or a combination of these, used to uniquely identify and distinguish one business's goods or services from those of others. According to the Trade Marks Act, 1999, a trademark can also include the shape of products, their packaging, or specific color combinations, as long as these elements can be graphically represented and serve to differentiate one offering from another.

Types of Trademarks in India 

In India, there are several types of trademarks available for registration, each serving distinct purposes and meeting diverse needs. The goal is to help consumers easily identify products and services associated with specific manufacturers or service providers. Here’s a breakdown of the main categories of trademarks available for registration: 

  • Product Mark: A product mark is attached to goods or products, helping to signify their origin and maintain a company's reputation. Generally, trademark applications in classes 1-34 are categorized as product marks, covering tangible goods.  Example: Coca-Cola® on beverage bottles.
  • Service Mark: Similar to product marks, service marks are designed to identify services rather than physical items. These marks help distinguish the providers of specific services from others. Trademark applications in classes 35-45 are typically considered service marks related to service offerings.  Example: FedEx® for courier and delivery services.
  • Collective Mark: A collective mark signifies certain characteristics of products or services linked to a particular group. It allows individuals or entities to collectively protect and represent goods and services. The holder of the trademark may be an association, a public institution, or a Section 8 corporation.
  • Certification Mark: Certification marks are granted by the owner to convey information regarding a product’s origin, composition, quality, or other relevant details. These marks help establish product standards and assure consumers that the product meets specific quality benchmarks. You often find certification marks on packaged goods, toys, and electronics.  Example: CA® (Chartered Accountants of India) is used by members of the Institute of Chartered Accountants of India.
  • Understanding Trademark Symbols: Trademark symbols play a crucial role in signalling the status of a trademark, helping to differentiate between registered and unregistered marks. Here’s a quick guide to the most frequently used symbols: TM (™), R (®), and SM (℠).

TM Symbol (™) 

This symbol is utilized by brands that have submitted a trademark application, even if it's still in process. It can represent both goods and services, effectively communicating to others that the name or logo is claimed as a trademark, while also serving as a caution against potential infringement.

R Symbol (®) 

When you see this symbol, it means the trademark is officially registered with the Registrar of Trademarks. Unauthorized use of a registered trademark can prompt legal action from the trademark owner to protect their rights.

SM Symbol (℠) 

Similar to the TM symbol, the SM symbol is used for service marks that have not yet been registered. It specifically pertains to services, signalling the same claims for protection and warning against infringement.
